We were not at war with the Soviet Union when the Rosenbergs decided to spy for them, and guess what happened to them? And those were civilians - not military officers.
I don’t think the Rosenbergs were convicted of treason though they got hit for espionage and technically that could happen even if someone was spying for an ally like England or Israel. It probably wouldn’t but it could.
