I think the point being made is that the judge in question isn't high enough to actively contradict those very old rulings, for all it's quite likely to be a case of hunting for a supporting position rather than honest respect for following the proper procedures for reform.

Of course, since this is about who can and can't have guns and there's more of the structure of the law against them, they're liable for a very nasty time. Because there are so very many parts of it they have to go to the Judiciary for. And also the possibility that Congress flips this year...
