Derek Chauvin Trial: summer 2020 electric boogaloo

We will know. The juror names are (probably) going to be public info soon. Juror names are actually public info in the US with some exceptions (usually organized crime trials).

Derek Chauvin Trial: summer 2020 electric boogaloo

That you think unfair convictions are new, or that this, even if it is unfair, is some special kind of new, is just wrong. There's a guy in Texas who got life in prison for not paying a ~$200 fine. Waco. The cops can blow up your house in pursuit of a suspect and it doesn't count as a taking...

Derek Chauvin Trial: summer 2020 electric boogaloo

+ Oh, I know intimidation happened. Whether it will be judged enough to overturn the trial I doubt. Fair, calling it hope is a little wrong on my part. Though I actually think 2nd degree manslaughter is less likely than 3rd degree. Personally, I think this should be declared a mistrial because...

Derek Chauvin Trial: summer 2020 electric boogaloo

That's all outside the jury room. I'm talking about discussion inside the jury room specifically. It's almost impossible to convict a juror of malfeasance. Intimidation, on the other hand, can overturn a verdict into a mistrial. That seems possible, but unlikely. The things that don't get...

Staff: Off topic stuff being moved

THIS IS THE THREAD TO TALK ABOUT THE CHAUVIN TRIAL, NOT ANOTHER INCIDENT. THE OFF TOPIC POSTS ARE BEING MOVED HAVE BEEN MOVED.

Derek Chauvin Trial: summer 2020 electric boogaloo

All of the charges are 'manslaughter' in the common use of the phrase meaning unintentional killing. Murder 2 was unintentional killing while doing another felony, Murder 3 was unintentional killing while doing something eminently dangerous and showing no regard for human life, and manslaughter...

Well this guy's just wrong. None of the charges were for intentional murder.

No. It's very difficult to appeal what goes on in the jury room, unless you know racial bias or something like it occurred. Any conviction would have been appealed, the full conviction just makes it more durable, absent a full mistrial (looking at you, Maxine Waters). Not how it works I...

That they applied CPR was something you claimed, and it was wrong. I then pointed out that it was false. If CPR happened, especially by Chauvin, he'd have a defense against being a depraved man who didn't care if Floyd died. The problem wasn't the lack of CPR, but the continued force applied...

Derek Chauvin Trial: summer 2020 electric boogaloo

So first, it's not ridiculous, doing dangerous things to someone that you don't think will kill them, but you do, is clearly illegal, and should be, to stop people from killing people with unprovable intention. Second, there was plenty of evidence on Floyd dying to the restraint. And that's not...

This is exactly what Maxine Waters wants. A Mistrial, so she gets to do the whole song and dance again. Chauvin is quite guilty of 3rd degree, but this isn't the way to do this.

No, he didn't follow the rules. Restraining someone you know has no pulse isn't following the rules. Cops don't get to do whatever they want, and this is beyond that. The guy is just not a good person, showing a fundamental lack of care for a person in his care.

Derek Chauvin Trial: summer 2020 electric boogaloo

The first gets stuff wrong. The depraved indifference standard of the 3rd degree murder is what's going to hit. Because the Jury doesn't, and shouldn't, know it's legally dubious, as juries decide facts, not law. The law question already got answered and the jury don't even know it got asked...

No, again, those regs, if they exist, are illegal and don't count for shit. Graham v Connor is controlling here: https://en.wikipedia.org/wiki/Graham_v._Connor Again, it's objectively unreasonable to apply force to an unconscious man. All of the factors listed are a no. Severity of the crime...

Derek Chauvin Trial: summer 2020 electric boogaloo

And that's not difficult here. Chauvin caused the death. I don't see a reasonable way that putting ones body weight on an unconscious man who has no pulse didn't contribute to the death. And then the rest is plain and obvious, other than the felony, but I could see a felony conviction too...

Again, the original restraint no, after he has no pulse and you know it and you do it minutes, 100%.

Derek Chauvin Trial: summer 2020 electric boogaloo

For both manslaughter charges and all the murders, one needs to find that Chauvin caused Floyd's death, and all of the ones Chauvin is tried with are unintentional as well. The clearest one is murder 3: Holding a person without a pulse down by the neck would easily apply.

Derek Chauvin Trial: summer 2020 electric boogaloo

And that's irrelevant. Sitting on Floyd's back could have killed him at the time, so putting the full weight on the guy with knee will kill someone in as poor of a condition as Floyd, knee on the neck or no. It makes it harder to breath, was against police protocols, and was judged to be...

Derek Chauvin Trial: summer 2020 electric boogaloo

Not really. They were part of the arresting officers, and all have a duty of care to people in their custody. Fortunately for them Minnesota's Felony Murder rule makes sense, so they can't be charged with murder. But yes, they do need to be charged as well for not fulfilling the duty of care...

Derek Chauvin Trial: summer 2020 electric boogaloo

By stressful situation, I was referring to a literal physical position one can be in that makes one stressed (elevated heartbeat, etc, which doesn't help a bad heart). Being held down on the ground is one of those. This could be a defense to second degree (that Chauvin committed no felony). But...
