Generally each charge has different standards for the burden of proof that the prosecution has to meet. The standard to convict for Manslaughter or Murder 2 will vary wildly from third or first degree murder etc. And Juries are obligated by law to convict solely based off those standards...

Well that's getting overturned on appeal. There are some states where it's not even legal to do that due to the standards.
