So Breyer is apparently retiring come the end of the current term (June). Odds are strongly in favor of Biden getting whomever he decides to nominate confirmed, probably on a party lines vote.

Theoretically, Republicans could kill the nomination but it's highly unlikely that they will. The Senate Judicial Committee needs to vote out the nominee to get them an up/down vote and that Committee has eleven members from both parties, and a tie doesn't advance the nomination. A motion can be made to advance the nominee to the floor ignoring the committee but that would take sixty votes to go anywhere under current rules.

As I said, it theoretically could be blocked but its highly unlikely that it would be.

Aaaaaand cue the rat race (or is that donkey race?) among the Dems to see whose "favorite nominee" gets the nod.

Although the potential field is already narrowed.

ideally we get a moderate, but at the end of the day you have a republican majority which would still work to limit bidens most stupid antics.

Compromise is dead. They will pick a black woman with activism experience that they claim is legal experience. Someone involved in a large number of civil rights lawsuits as a plaintiff. They will brag about her experience getting laws changed through the judicial system.

It will probably be a stealth candidate. Like Sinema, palatable on the outside, despicable on the inside.

She's not Black enough.

Most people ATM are stating it'll be Ketanji Brown Jackson as most likely since she's liberal, Black and female and this fulfill Bidens campaign promises for a Black woman on the Supreme Court.

No it can't. She's not even remotely qualified. Whoever the candidate is, they're already working as a judge somewhere in the federal court system.

What qualifications? Unlike senators or presidents the constitution puts no requirement on who can be a justice. If you can get the president to nominate you and congress to agree you could be one or even a child.

SC justices have to have actual experience within the federal judiciary. Granted, that's not a requirement imposed by the constitution, it's a requirement imposed by the practices and expectations that have developed over time. But it's a requirement nonetheless.


Besides, why would they even want to put Kamala on the court?

It's going to be either Krueger or Kentaji Brown.

This seems like a staggeringly bad move by the Democrats. Few things energize the Republican base as much as the Supreme Court and they just announced an opening immediately before an election. Granted it's a midterm but there's still going to be a push to block any Biden nomination.
