Fish are practically the platonic ideal of a Tragedy of the Commons. Every fish you don't catch might be caught by your competitor to their benefit over you.
China has a highly disputed sea with multiple belligerent neighbors fishing in the same waters. Their default strategy is to absolutely devastate the fish supply by taking as much as they possibly can in order to keep their neighbor states from getting any. It's crazypants enough that it sometimes devolves into naval vessels shelling "enemy" fishing boats.

People already do - remember that video 4-5 years ago of the Argentinean Coastal Guard sinking a Chinese fishing vessel. Calling the Chinese fishers pirates would allow people to hang the ones that are caught(theoretically, of course).

As far as I can tell, the Chinese fishing fleets aren't pulling this sort of shit with the US... yet. Right now they are fucking with Ecuador instead(which does limit any potential US retaliation, of course).

China doesn't want to declare war; because they know they'd lose more than they stand to gain in any conflict, in the long run. Instead, they're just using the threat of war as a scare tactic, and pushing to see how much they can get away with before anyone tries to stand up for themselves. It was a sound strategy in retrospect; considering the fact that they employed it for decades without any notable push-back from anyone.
Now however? That particular gravy train, among many others, is coming to a halt; and the CCP know it. Which is why they've begun to lay the groundwork for China becoming yet another insular dictatorship; by shifting focus away from controlling the Chinese population with prosperity, and more towards controlling them with fear of the outside world.
