Not exactly. The payments aren't what's considered illegal, it's how they were accounted for that is being claimed is illegal. "Falsifying business records" is what they're charging him with, by claiming that the payment to Daniel was improperly categorized as a "legal expense" in his paperwork.

That is something for the prosecution to prove. Yes he has been indicted....problem is Trump is stubborn enough to ask for a speedy trial and then bury them in evidence he didn't do it.
An indictment is NOT a conviction.

It's all bullshit. However, I fail to see what difference is supposed to be. If the man had put, say, "private settlement" on the books does that suddenly make the transfer of money legal or something?

the actual indictment has not been released yet. we know it is the stormy daniels payment. CNN claims it is 34 mislabeled business finance things (from an anon source so take it as a bout as real as russia gate was). however the only way they get around the statute of limitations issue is if they can connect the financial error to the commission of other crimes that also are not past the statute. so until we see what that is we really can't know for sure this is anything but a political prosecution.
I'm a little concerned because of a potential Jury Trial using a New York Jury. I'd be very concerned based on the number of free strikes given out during voir dire (jury selection). I'd honestly trust it more if the number is low, as too high of a number enables getting rid of a minority easier. And in this case, the relevant minority is Republican Jurors.

if trump has any lawyers worth a tenth of what he is paying them a change of venue based on prejudice is an easy argument. if it gets refused that is an easy appeal based on basic survey data. if that happens that is an even better outcome for him in terms of marketing to conservatives and people who claim to want a more moderate society. imagine if when presented with data that says NYC is completely biased against orange man that the presiding judge refuses to change venue. that will get plastered all over media. if the appeal fails? that is another layer to just how far the corruption goes. every layer that refuses to acknowledge the political reality on the ground adds more weight to the right wingers saying this is just political. under the hypothetical that it stays political the entire way up the chain and the SC rules against orange man? I shudder to think of the rift torn in society. every refusal to acknowledge it will add to the damage.
Likely not. No one else is stupid enough to take on this case. Fuck, when even Andrew Cuomo is saying this is bullshit, that counts for something. New York District DA is doing this on partisan grounds. No one else wants to touch this. This is a make or break case for the DA as I don't know how he keeps his job when this inevitably fails.

I would argue the opposite. being the judge that just fucking says it is an easy win that makes your career and puts your name in the history books. it takes a partisan judge to push this. anyone with a concern for more than the 1st order consequence of hurting orange man now is gonna see that this is an awful strategy. hell if the current judge wants to seem less partisan he can throw it out now. it would just throw the DA under the bus while he is being ridiculed by everyone who isn't TDS.

I wouldn't bet against TDS either at this point. people cannot be rational with him. I have seen enough to know that people will be willing to allow america to burn down and fuck anyone else if it means they finally get him. I just have enough hope that most people who aren't that will see it for what it is. and if we don't got that then america is lost and needs whatever internal focus is needed to understand that they can't fuck themselves that badly and remain #1 in the world.
